Bill of Lading and Ownership
The bill of lading issued by Turk Logistic Line Intl is non-negotiable. The sender acknowledges that it was prepared by the sender or by Turk Logistic Line Intl on behalf of the sender. The sender guarantees that they are the rightful owner of the goods being transported under this document or that they are authorized to act on behalf of the owner.
Sender’s Obligations and Representations
The sender agrees and warrants that:

Each item in the shipment is described accurately and in detail on the bill of lading.

The shipment contains no prohibited or non-transportable materials.

All shipment information has been clearly and correctly provided, and the shipment is securely packed and labeled to ensure safe handling during transport.
The sender understands and agrees that Turk Logistic Line Intl reserves the right to refuse or abandon any shipment or part of it if it is deemed unacceptable, undervalued for customs, or misdescribed, without incurring liability. The sender agrees to hold Turk Logistic Line Intl harmless from any claims or damages arising from such decisions.
Costs and Expenses
The sender is solely responsible for all costs related to the shipment, including but not limited to:

Customs duties, taxes, and any other applicable charges

Costs associated with the return, storage, or disposal of shipments if necessary
Shipment Handling and Third-Party Services
Turk Logistic Line Intl may, at its discretion, subcontract or use agents to perform part or all of the transport services without liability for the acts or omissions of these third parties.
Right to Inspect Shipments
Turk Logistic Line Intl reserves the right to inspect shipments at any time but is not obligated to do so. Inspections may include opening and examining shipment contents. While reasonable care is exercised, Turk Logistic Line Intl is not liable for any damage or delays resulting from such inspections.
Cargo Security and Payment of Charges
Turk Logistic Line Intl reserves the right to retain possession of shipments until all freight charges and associated costs are fully paid. Shipments may be withheld or refused delivery until such payments are settled.
Limitation of Liability for Direct Loss
Direct loss refers to the destruction or permanent loss of the shipment or any part thereof while in the custody of Turk Logistic Line Intl or its agents. Turk Logistic Line Intl’s liability is limited to direct loss only.
Turk Logistic Line Intl is not liable for any consequential losses, including indirect damages or losses resulting from breaches of the carriage agreement.
Exclusion of Liability for Delays
Turk Logistic Line Intl is not responsible for delays in receiving, transporting, or delivering shipments caused by:

Actions or negligence of Turk Logistic Line Intl employees or agents

Events beyond reasonable control such as natural disasters, war, political unrest, or government actions
-
Actions or negligence of the sender, recipient, customs officials, or other third parties involved in the shipment
-
The inherent nature or condition of the shipment
Claims Procedure
Any claims must be submitted in writing within 15 days of the delivery date. Turk Logistic Line Intl reserves the right to refuse claims reported after this period.
Claims will not be accepted unless all outstanding fees due to Turk Logistic Line Intl have been paid in full. Claims cannot be offset against amounts owed.
Prohibited Items
Unless explicitly authorized in writing by Turk Logistic Line Intl, the following items are prohibited from shipment:

Currency, stamps, works of art, jewelry, precious metals, gemstones, bullion

Firearms, explosives, bank checks, payment orders, traveler’s checks

Antiques, plants, animals, medicines, drugs, foodstuffs, liquids, tobacco
-
Perishable goods, negotiable commercial papers, obscene or pornographic materials
-
Hazardous, flammable, or dangerous goods as defined by international and local regulations
-
Any other items prohibited by Turk Logistic Line Intl or relevant authorities
Insurance
Insurance coverage for shipments is the sender’s responsibility. The sender must notify Turk Logistic Line Intl in writing if insurance is desired, specifying the nature, value, and coverage needed before handing over the shipment.
Any claims for damage or loss during transit are the responsibility of the insurance provider.
Governing Law and Jurisdiction
Both the sender and Turk Logistic Line Intl agree that all matters relating to this agreement shall be governed exclusively by the laws of the Republic of Turkey. Any disputes will be subject to the sole jurisdiction of Turkish courts.
